Sentence for aggravated assault w/ deadly weapon on officer?
My cousin recently was incarcerated in Tennessee for aggravated assault with a deadly weapon on an officer. He also racked up criminal trespassing, driving with no license, and resisting arrest.. He also is an undocumented illegal immigrant. What kind of charges is he facing? Is deportation the most obvious sentence? He obtained a lawyer but I live in FL and haven't spoke to him. I just looked up his record.
Answer:YES
Answer:He's probably going to get deported.
If he is not deported, he will serve more than one year in prison.
Answer:He will serve prison time (depends on the injuries probably at least 5 if no injuries at least 20 yrs if serious injuries). He picked a bad year to commit such a dangerous crime – the jury will be extra hard on him and then the judge. At the conclusion of his prison term he will be deported. If he sneaks back in – each time he is caught here will be a extra felony with more prison time.
Answer:Aggravated Assault on a Police Officer, in Tennessee, is a Class B Felony crime, carrying a punishment of not less than 8 years nor more than 30 years in prison, In addition the jury may assess a fine not to exceed $25,000.
The other crimes, while serious do not even come close the Assault charge. The sentences for those crimes will probably be served "concurrently" with the Assault sentence; that means he will serve the jail time for those offenses at the same time he serves the Assault sentence.
If he has a sharp lawyer, maybe they can plea bargain the Agg. Assault charge down to something like Assaulting a Police Officer. That is a Class D or E Felony, carrying a maximum of 1 to 6 or 2 to 12 years in jail.
If this is a first offense for this kid, he might catch a break. Ironically, while he is in prison, he can take college classes, even earn a degree.
